We granted Petitioner SCDOT's petition for a writ of certiorari to review the court of appeals' decision in Marlowe v. S.C. Dep't of Transp., 441 S.C. 319, 893 S.E.2d 21 (Ct. App. 2023). The Court will determine whether the court of appeals erred in holding (1) there was a genuine issue of material fact as to whether SCDOT committed an affirmative, positive, and aggressive act that caused flooding on Respondents' property for the purposes of inverse condemnation, and (2) the Stormwater Management and Sediment Reduction Act did not immunize SCDOT from liability.
